  • L2 Visa for employed spouse

    Hi All,

    My wife company is applying for her L1 B visa along with the L2 for me.I work for other company and i came to know from some of my friends that i need to have the "NO OBJECTION CERTIFICATE" from my employer stating that either i am going for a leave for 1 year or i'll be quitting this job before travelling to US on company letter head, and we need to have this NOC document before going for Visa Interview.

    i just want to know is it true, because i am not sure whether my company will give me the NOC or not and at this stage i cannot quit the job as i don't know whether my wife will get the L1 or not.

    please help me on this.Thanks for your help in advance

    There is no such rule if you are working for a private sector company. It is recommended to have that if you are working for the State/Central Govt or any of their funded establishments.

      thanks raghvi, for your instant response on this..But this NOC document is in the list of documents provided by my wife's company.

      If i don't go with this document as my company has refused to provide me the one, and if the consulate people ask during the interview time for NOC then what could be the answer which i should give to them.

      Or how much are the chances to get the visa if i resign from the current company and take the print of approved resignation email Will it work?

      please help me out i am confused what to do and what not to do?

        The NOC is not a US Immigration Requirement for private employment. And I think your spouse can send a mail to her internal Immigration Team as well as her management stating that this document cannot be provided as you cannot be expected to resign before the result of the visa interview is known. I think they will agree.

        If in the Consulate they ask you, you can always mention that you plan to resign after getting the visa and before travelling. There is no harm.

        If I were you I wouldn't resign without having the travel ticket for self and spouse in hand first.

          thanks raghvi, for helping me out in this matter and suggesting me the solution to how to answer the consulate.

          But it raised on small question in my mind, if i say that i am planning to resign after getting the visa.Then they might ask that what will you do in US. I know on L2 after getting the EAD i can work.

          But is it good to say that i will work over there after getting the EAD. Hope this will not be the case for rejection if i tell them the truth and show my intention to work in US after getting the EAD.

          Might be my question are not to good but your help on this is highly required and appreciated.

            If you really intend to work there, I dont see any issue in being honest, do mention that you will work only after getting the EAD.
