I94 Extension Applied - Valid Visa - Travel to India?

  • I94 Extension Applied - Valid Visa - Travel to India?

    Hello Members. Can you please help in the following

    The i94 extension for me and my wife is in process now. I have a question regarding travel - here is the situation.

    1. Both me and spouse have valid L1/L2 visa till mid 2015.
    2. Spouse i94 expires in January 2014. My i94 expires in May 2014.
    3. The extension for both of us has been applied for by the company and should have receipt by end of January

    We are planning to travel to India for 3 weeks in March. While both of have valid L visa on same customer / location, wife's i94 would have expired. Do you see any issues in travel, especially while exiting US. Will the receipt be valid to show extension has been applied and will not be classified as overstay?

    I dont see much of an issue and don't see a point in applying for an extension for yourself when you are planning to travel in March. Yes, in order to stay from Jan 204 till March 2014 your spouse does need extension filed. Any idea why you got I-94 less than visa expiry date? Are your passports expiring?

      The passport for my wife was expiring hence she got i94 only till that date. Both of us have applied for extension.
      We are planning for a vacation in March, just wanted to ensure there are no issues while exiting USA as she will only have extension receipt. Since our visa is still valid, there is no issue in coming back.

        Assuming you have got your spouse's passport renewed I dont see any issue with applying L2 extension request.

        I still didn't get why you got I-94 only till May 2014 and why you need to apply for extension when you are travelling in March 2014 before I-94 expiry?

          Yes, passport has been renewed. This was easier to apply i94 extension together as mine is expiring just 4 months later as advised by company. Else I would have to again apply for i-94 extension in May.

          Do you see any issues in travelling on extension receipt?

          I have no idea why they gave me i94 till May 2014 (only two years from date of entry). My passport is still valid for next few years.

            I am also confused that when you have visa till 2015 why you I-94 only till May 2014. Anyways, extension receipt , apart from purposes of references later on, and proving that extension was filed timely for your spouse doesnt have any more meaning.

            Filing extension for you doesnt make sense as you are planning to go out in March 2014. When you return, you would get a new I-94, so extension request doesnt matter if you file it and then leave US.

              Thanks, just one question: Do you think while travelling to India at the US airport, will they see any issue with respect to my wife's i94? It would have been expired by then and she would only have the extension receipt.

                I dont see any issues with that. Keep the Extension receipt for your future references.

                  I also have the same issue with my I 94 and passport expiry,can you please provide me complete details on how to get new I 94. .Now I applied for my passport renewal.can we get I 94 extended from employer ? If not how do we have to do it on our own.please do help me with required info.i cannot travel outside too as I'm more than 28 weeks pregnant and I heard from some body that on the basis of discretion from CBP office we can get new I 94 from local CBP office or airport ,is that true?please suggest me.
