    Hi,

    Currently i'm working in L1-B visa valid till June 2017, my approved L1-B petition & I-94 valid till June -2015. I'm in the process of converting my visa from L1-B to L1-A. I have a travel plan to go India for 5 weeks in July 2014 and below are my questions.

    1. Assume that my L1-A petition is approved before my travel date but i have not done L1-1 visa stamping in consulate before my travel. In this situation, what would happen if i travel to India and come back to US.

    a) Would i be able to re-enter with my Old L1-B visa since it expires only by June 2017 and my L1-B petition approval & I-94 expires by only June 2015?

    b) If answer to question (a) is No then do i need to get visa stamped in India before i come back to US?

    2. Assume that my L1-A petition is approved during vacation time when i'm in India. In this situation, what would happen if i want to come back to US.

    a) Would i be able to re-enter with my Old L1-B visa since it expires only by June 2017 and my previous L1-B petition approval & I-94 expires by only June 2015?

    To avoid complications its always best to avoid a travel out of country while a COS or extension is pending. If you really need to travel, travel after the decision is made or file L1B to L1A after coming back.
