  • L1 Blanket Stamping in Canada while current Passport expiring in 10 months

    Hi,

    I'm in Canada now and going for L1-Blanket stamping in Canada. My current Passport is expiring in next 10 months (Oct 2014).

    Question is:

    1. If I don't renew my passport now and go for L1 stamping with existing Passport, then will I get L1 VISA approved and stamped only till my Passport expiry date (i.e. Oct 2014)...??
    2. Should I renew the Passport first and them go for L1-VISA Stamping...? If this increase a chance to get VISA stampped with longer validity...??
    3. What is the success rate for L1-VISA Stamping in Canada..? Should I ask my employer to process L1-Individual instead of L1-Blanket...??

    Please suggest.

      1. Visa would be as per the I797/Time remaining on L1 (L1B 5 Years Max and L1A 7 Years Max).
      2.I don't think that is required.
      3. I don't think there is data available in public domain with respect to particular consulates. As per USCIS data I believe the success rate globally for L1B was around 73% in 2012.

        So, that means during VISA stamping, the VISA validity depends on I-797 approval, not on Passport Validity. Right..?

        Other question is:

        1. I'm going with L1-Blanket, and not L1- Individual. So, I don't have a preapproved I-797.Then, on what basis the VISA validity will be approved..?

        2. While entering into USA, at PoE, the I-94 will be given based on L1-VISA or passport validity..??

        Please clarify.

          Well as long as the passport is valid more than 6 Months I dont see any issues.
          1. Blanket L1s also have a Blanket I797 associated with them only thing the date is generally valid indefinitely for L1B. I am surprised that you dont have a I797 given by the company. You should have that document.
          2. Generally the earliest of : Passport expiry, Visa expiry OR petition expiry.
