  • L1B visa holder marriage to a US Citizen

    Hi,
I am currently on an L1B visa and am planning to get married to a US citizen (not a naturalized citizen).
I would like more information regarding visa rules/regulations.

    1. Once we are married, can I change my visa status so that I am free to switch jobs and not tied to any particular organization. From what I have read, its called an EAD which will be provided within 90 days of us filing at the USCIS?
    2. Will this EAD require me to leave the US for stamping?
    3. How long until I get my Green Card?

    Much appreciated.

    1. Yes by having your spouse file the I130 Package and you filing the I485 Package for the Adjustment of Status. Yes you should get the EAD within 90 Days which will enable you to switch jobs.
    2. No need. In case you want to leave US you would need to file for Advance Parole Document.
    3. It depends upon your country of birth.

This is my opinion not legal advice.

Thanks very much. I do have a few follow up questions:
      1. On the assumption that we file for the I-130 and the I-485 package and its approved, what will happen to my the L1B visa with my existing company?
      2. Based on the above point: I assume I will have to inform the company of my change in status from L1B to EAD? Can I continue to work with my existing company who had sponsored the L1B once the I-485 is approved?
      3. Will my passport be stamped with the EAD or is it just a document?

      Much appreciated.
