  • salary for L1A Executive?

we are in the process of setting up new US office.

i am the beneficiary. my lawyers say the salary of L1A is CEO equivalent and should be around $150k per year
    is that true?

from our company point of view its a lot because we are only starting and can do with a lower salary in order to avoid burden on the company

if anyone here is on L1A can advise range of salary expectation for business plan?

Technically there is no minimum salary requirement, but yes, the higher the better. Also, salary is more of a placeholder to determine if one belongs to an executive category/specialized skill set category. Its like when we hear it, we know it that the person is executive or must be having something special to be get paid that amount.

Rest, I would leave to experienced L1As who got L1A stamped recently to comment. I do see some experiences in the recent successful L1A experience section http://www.immihelp.com/l1-l2-visa-experiences/ mentioning a figure of 120K.

This is my opinion not legal advice.

thank you for your kind answer appreciate the help.
      so i get it now.
now, i want to know about the L1A application needs to be in chennai or can be also in mumbai? coz i am in mumbai

also i want to know how difficult the interview is normally because i heard that there are not many questions asked by visa officer and its mainly for stamping visa because whatever queries are there are raised by RFE before

also i have a tax related question, what is the rate of tax in US for the income tax? 30% ? will I be taxed at this rate if i am not a US citizen?
      thanks

If it is L1A Blanket it has to be scheduled at Chennai. If it is L1A individual then I believe you can schedule the interview at Mumbai. As for interview question do refer the experiences section at the link provided earlier. I wouldn't suggest you take the interview lightly. It takes a different approach while facing the interviewer than while writing the same in documents. Be confident and well prepared.

Tax related... depends upon a lot on the state where you will be working as well as family members dependent upon you and medical deductions. I don't think its as high as 30%. You will be taxed as any normal US citizen would be.

Even in India I dont think one pays 30% flat of the CTC as there are deductions allowed for HRA/Home loan/Section 80 C etc. of course those deductions are not be allowed in US. There isnt much tax planning that you can do while on L1/H1 unless you buy a house or open a 401K....sort of like EPF a benefit you will get only if you continuously contribute for 10 years ...If need be do discuss with a tax expert once you are in US

This is my opinion not legal advice.

i got this info from IRS

Persons not eligible for the standard deduction. Your standard deduction is zero and you should itemize any deductions you have if:
Your filing status is married filing separately, and your spouse itemizes deductions on his or her return,

You are filing a tax return for a short tax year because of a change in your annual accounting period, or

You are a nonresident or dual-status alien during the year. You are considered a dual-status alien if you were both a nonresident and resident alien during the year.

If you are a nonresident alien who is married to a U.S. citizen or resident alien at the end of the year, you can choose to be treated as a U.S. resident. (See Publication 519.) If you make this choice, you can take the standard deduction.

First determine if you will be treated as resident or non resident for tax purposes.
