H4 to L Visa

Hi

Can some body tell me about the possibility of change from H4 Visa to L Visa. I had came to the US on a vacation and i am in the US for last 40 days. Now my company in India is offering me L Visa. Is it compulsory that i go back to india for L visa processing or can i start processing L visa being here in the US.

Also should i go to India for attending the Interview ( in US Consulate ) or can i attend the interview by going to Canada.

Technically you should be able to convert from H4 to L1 while in US. But if USCIS approves the conversion as consular process then you would have to leave US and go for L1 stamping at a US consulate. Generally first time H1/L1 stamping is done from home country if you don't have a US degree.

Check this link, this person had a very similar situation as you. Don't know what happened to the stamping though.
