  • Applying for L1 Individual if H1 process has started

    Hi All,

    My employer has initiated the process of filing H1B visa for me for the Fiscal Year 2015. But with a statutory H-1B cap of 65,000 per year, it is all your luck.

    My question is can my employer start with my L1 Individual processing (process usually takes 7-9 months) in parallel. Is that legally right provided I will also be going through H1 processing. Please let me know

    Two different visa types, two different petitions, I don't see anything illegal about it. If both get approved eventually at some point of time you might have to abandon one over the other.
