L2 Visa application on Expired L1 but valid I 94

Hi my L1 has expired in Aug 2013 but my I 94 is valid till Dec 2014. My wife's L2 visa has also expired on the same date and she has I94 till April 2014. She has to go to India for a family emergency. As I am still working here, can she apply for a L2 based on my I 94 to come back to US in 15-20 days. My I 94 or Visa extension will be applied after June 2014 as per our company policy.
Please suiggets it is very urgent.
