  • L1B to H1B

    Hi,

Currently I have L1B with valid I-94 till May,2016. If I am getting a sponsor for H1B 2014 (Not current employer) for fresh quota this year

    - I will have to start working for the new employer immediately from 1st oct 2014, in case H1B approved?
    - In case - H1B not approved, will there be any issue with current L1B visa?

    1. If you process H1 as COS then yes you have to work with the new employer. If you process H1 as consular process then you can continue to work with L1 employer, but would move to H1 only after a subsequent successful COS to H1 or when you leave US , get H1 stamped and return on H1.
    2. if H1B is not approved it will not impact your current L1.

This is my opinion not legal advice.
