  • In US on L1 visa but lost L1 approval petition and apply for H1B

    Hi,

I am in US on L1B visa for 3 years. I have i-94 valid until Sep-2015, so I can work in US.

This year I am applying for H1B but i have lost L1 Approval petition. I think its I-797 form. Not able to find it.

I have i-94 with me. Does it consider as L1 approval document? Or is it ok to provide i-94 instead of I-797 document?

If I-797 or L1B approval petition/document is required, can I get duplicate copy from somewhere?

Please help. Lots of questions are troubling me due to this issue.

    Thanks well in advance.

    Regards,
    JK

Technically you dont need the L1 I797 to file H1 in April 2014. Also, the L1 employer should be able to provide you a copy if need be.

This is my opinion not legal advice.
