Grace period for spouse(L2) if my L1B extension gets denied

  • Grace period for spouse(L2) if my L1B extension gets denied

    My Detail:
    L1B expired, I94 valid till 2016

    Spouse:
    L2 expired, I94 valid till 2016

    I am planning to go for L1B extension in March 2014, my wife will remain in US while i go for extension, cant take her for extension for some reason.

    Question: If my L1B extension gets denied, then do my wife gets any grace period to settle things? or she will have to leave immediately?

    Please advise.

    You mean going for fresh L1B stamping. Technically there is no grace period for L2 when L1 is not present unless a hardship can be demonstrated which can be quite difficult.

      No, I will be going for L1B extension. My company's attorneys said my family will get 7 to 10 days to settle things if my extension gets denied.
      So just want to validate that.

        Well, that normally happens when ones extensions request is rejected while in US.

        But I would say it would not be considered a gross violation by USCIS if the family stays for a week or so at max to wrap up things and leave.
