L1 to H1 - Travel to India after COS Approval and before Oct

Hi ,

I am on L1B and planning to apply for H1 COS in April 2014 in Premium Processing.

Question - If the COS goes through lottery and is approved by lets say Second week of May , can I travel back to India (project getting over) after approval and come back with approved petition after stamping in Mumbai in Oct'14?

Unless you file in premium, it would be difficult to get approval notice in hand by May 2014. But if the idea is to leave US in May 2014, and return after getting H1 stamped then why are you filing a COS and why do you need to get approval by May because as it is the H1 can start only from 01-Oct-2014 or later, with or without COS.
