  • What are options after L1A Blanket rejection?

    I had my L1A blanket rejected few days back. I was rejected perhaps based on Org chart. What are the best bets for me going forward?

    Should I go for L1B or H1B or L1A blanket? I want to get visa asap.

    Plz share your comments/thoughts/experiences.

    I would say L1A individual. If your role is suitable for L1B you can file that too. H1 can be a good option too if you are going to work for an end client and if L1A and L1B arent suitable for your work profile .

      I want to know basically why do you feel that it might have got rejected due to Org chart, can you describe whats the ideal org chart expected for L1A Blanket. Even I will be attending this interview in the coming month

        Without seeing the documentation it would not be possible to comment, also if you can post the Q&A you had with the visa officer it might give some pointers as to what went wrong. L1As are hard to come by and may face denial if VO get even the slightest of doubt about your eligibility.

        When you say " I will be attending this interview in the coming month " do you imply another L1A interview ? as you already mentioned that you got rejected once.

          L1A Blanket rejected

          This was L1A blanket. VO only asked me client name, India salary & US salary. Slightly raised his eyebrow and confirmed US salary. But I know this was not the issue as one of my colleague having same salary got the visa.

          Then VO asked for Org chat. Did something on his computer for couple of minutes and looked at Org chart as if he was irritated or confused. Did not say or ask anything and then stamped I-129S with rejection. Said give this to your HR & they'll help you file in right category.

          In my Org chart I had shown my role as "Senior Operations manager" & 4 direct reports as : 1 Automation Test lead, 1 performance test lead, 1 project manager & 1 test manager. + 12 indirect reports under them. Thus total people under my hierarchy. My total experience shown was 9.5 yrs.

          Now based on this I don't have any clue what he found wrong in org chart. I'm wondering what different can I do if I go for L1A Individual.

          All comments/experiences are welcome.

            No two visa officers assessment would be exact. I feel your experience is slightly on the lower side. If at 9.5 Years you have a Project Manager reporting to you, whats the experience of the project manager? 6 Years? Then accordingly a lead is at 3 Years exp? Such an org chart will certainly not be very convincing. L1a was designed for higher level executives such as Account executives, directors, VPs etc, some lesser designated/role performing people still get L1A but USCIS and Consular officers have been very strict off late.

              What are the chances of prospective L1A Individual petition with same experience and same org chart ? Could you suggest some changes that can improve success probability ?

                Cant say with only this information. There would be multitude of documents to be submitted along with the Org Chart. I would say to try H1B too as a backup.
