As I am awaiting the result of the Service request created for revisiting the extension denial ( reason for denial- stating that I was not in the country (US) when my extension is filed.
Which I feel is mostly the overlook by the officer. Not sure on what basis the officer thinks I was not in the country. When my I-94, passport everything is clear.
Follow up question on the above subject:
1) My dependents -L2 have a valid I-94 till 2015, but my extension is denied ( still under review due to USCIS error if the decision is still negative for me). Can the dependents stay in US, while I travel back to India for VISA stamping based on the approved petition. Thus, in case I have to travel back, even after USCIS review they deny the extension.
Or is it advisable for the dependents are also to travel back along with me and get the VISA stamping in India ?
2) What happens If I alone travel back to India for visa stamping, if the visa is rejected for me. I will not be able to come back, will the dependent have any problem while they are in the US and the family plan to travel back after a couple of weeks after the result of my stamping.
