  • L1B to H1B thru Change of status process

    Hi,

    I am currently working on L1-B (Individual) which is valid till November 30th 2014; my current employer is planning to file H1B for me in April 2014.
    I would like to suggest my employer to file my H1B thru change of status process so I my visa status will change (L1B to H1B) after October 1st 2014.
    Could you please let me know what additional paper work needed with going thru Change of status process? Is there any risk under this process as I am already maintaining my L1B visa?

    Appropriate section needs to be marked in I129. In order to be able to do a COS to H1 on 01-Oct-2014, you need to submit valid proof of status as of 30-Sep-2014 or beyond, that can be achieved by providing your relevant I-94. As long as you or your dependents don't suddenly decide/need to travel out of US between now an COS date, I dont see any risk involved.
