L1A Stamping - Dependent visa stamping - Passport expires in December 2014

HI,

I am on L1A and recently got an extension till May 2016, including dependents.


We all are going for family visit to India, next month and getting Visa stamped on the extension.

But, my Kid's passport is going to expire by Dec 2014. I have already submitted DS-160 to get the visa appointment date with current passports.

Q1. Will the visa be stamped beyond passport expiry date?
Q2. Will POE officer give I-94 beyond passport expiry date?
Q3. Can I apply for fresh passport here in US itself and then go for stamping?
Q4. Will they accept the new passport for stamping? even though we have given the reference of the old passport number in DS-160?
Q5. What if we go now with the old passport only?

Please advice.

Please advice.

1. Yes most probably. It will match your L1A visa dates.
2. Most probably not , it will be issued only till Passport expiry.
3. Yes. But you have only a Month as you travelling next Month.
4. Yes.
5. As explained in 1 and 2 above. If I-94 given till Dec 2014 upon return, first get new passport and then request CBP to grant I-94 to match yours, if not file extension for your Kid using form I539.
