  • L1 RFE, L-H Conversion applied for

    Hi Everyone,

    I have got a RFE for L1 and in parallel am applying for L- H conversion. My i 94 & Visa both expire on April 09, 2014

    I have a couple of questions :

    1) If L1 extension gets denied and I have to go back what will be the impact on the L- H COS?
    2) If L1 ext is denied, how many days do we have to wrap up and leave? I mean how many days do companies typically allow their employees?

    Technically as your I-94 is expiring before 01-Oct-2014, unless L1 extension is approved, a COS to H1 would not be possible.

    1. COS gets abandoned. But you can still use the approved H1 petition(if selected in lottery) to go to a US consulate abroad and attend H1 stamping and return earliest by 20-Sep-2014 if h1 approved.
    2. Technically you go out of status and become illegal so companies cannot employ you or pay you legally. Companies generally ask employee to leave ASAP within a week or 10 days.
