L Visa is based on the company which you work for and not based on your qualification.

      L1 to H1

      Hi,
      I had a H1 in 2001 for 3 months from company A
and then I came to US on L1 from company A and its valid till 2006 Jan ,

and I am planning to stay in US , so I applied a H1 from company B
and recivied a H1 in Aug, I am planning to change to H1 company B by Nov 1st 2005 is that OK? or am I out of status?
      Thanks

If you have a valid H1B approval with a new I 94 then you are in status. Or if it has not yet come through then you will be in status till the date mentioned on your present I 94, sufficiently before the expiry of which you should file for you change of status. Do contact the co. attorney to ensure that you always remain in status.
