Should I apply for VISA from India if my extension pettition is denied?

L1B Extension Petition in US denied that filed before VISA and I94 Expiry. In petition processing got REF and finally a denial notice. Since I94 expired in-between on 6Jan2014 and denial status updated at USCIS site on 17Apr2014 (still waiting written denial notice); I booked ticket to India for 30Apr2014.
Will I would be considered as out of status stay from 6Jan2014 To 30Apr2014 (114 days)? I am planning to apply for VISA extension from India is there any chance or just wastage of time and money as petition here already denied?
I believe in India at US consulate they will ask why you came back on 30Apr2014 where your I94 valid till 6Jan2014 and I need to refer my petition here.

Please suggest and if possible asap as I have to make a decision here soon.

I also got the rfe and waiting for result. can you please share what was the reason for rfe?
I got my rfe for client letter.
just wanted to know if you also had the same reason for rfe. This will give me some hint on chances of getting approval/ denial

mk1977, what did you decide upon? did you apply for new l1 in us consulate? if yes, what was the outcome? I am in the same situation here.
