L1visa expired, valid I94 can apply for H1 Petition/Visa?

Hi All,
I have L1B visa which expired on April 20th 2014 but I have valid I94 till 5th Nov,2016. Currently I am staying in USA as I94 is valid.
And I want to apply for H1 for 2015 as i have valid i94 till 2016 .

Can any one let me know is that possible to apply H1 B petition when i m on L1 I94 without L1 B visa?

It will be really help you if you can answer my questions ASAP as based on that I have to make few imp decisions.

Yes it is possible as long as you haven't completed full 5 year L1B term before Oct 2015, also, in order for this to happen smoothly you cannot travel out of US between now till Oct 2015.

Also, I cant understand how this is urgent as the cap for this year is already over and the next year's cap will start only from April 2015.
