I was on L1-B visa and my visa got denied. I stopped working immediately and applied change of status to H4. I got my H4 approval after 3 months. The start date on I94 received with H4 approval, was date after 3 months and not the date from H4 receipt notice.
Later I applied for H1-B and it got approved. I left USA and travelled back on H1-B. Since then I am on H1-B. Recently my H1-B extension got approved. I got the extension till May 2015 whereas I was hoping to get the visa extended till Aug 2015.
After checking with my employer I discovered that 3 months period between L1-B denial & H4 approval has been considered as period spent on L1-B. Actually that was the period after my L1-B denial. Hence it should be either considered as "out of status" OR "H4" as I immediately applied change of status to H4 after L1-B denial.
I guess I should be allowed to work for those 3 months period. Can you please guide me on how to get I94 end date corrected?
As I am in the 6th year of my employment, those additional 3 months time is crucial for me.
