  • Does L2 need EAD/work permit to do work from home for Indian company

I will be traveling to US on L1 and my wife on L2 for short duration. My wife is currently working in India. My wife's company is ready to give her work from home option while she is in US. Does she need to get EAD/work permit to continue working for the indian company as work from home? Or EAD is needed only if working for US company and earning US salary?

Legally speaking, L2 needs EAD to work on US soil, irrespective of the original location of the company for whom they are working or the location of the bank at which salary/payment for the services will be credited. Also, as a tax paying resident the income will be taxed in US.

This is my opinion not legal advice.

Just to understand, does she have to pay tax(or be a tax paying resident) in US for the salary that she gets in her indian bank account by her indian company? because she will be paying tax in India for her salary/earnings credited in Indian bank account.
      Any info is appreciated.

There are provisions to avoid paying tax in both the countries. Check with a Tax expert.
