  • L1 VISA extension

    Hi All,

    I am on L1-B VISA currently with my family at US. VISA is getting expired on 2nd week of July - 2014. However, I-94 for my family valid till 3rd week of Oct - 2014.
    My I-94 is valid till Feb - 2017.(This happened because of my re-entry to US this year)

    So, it looks like we are good to stay at US till 3rd week of Oct - 2014.

    In the meantime, we are expecting birth of our new baby during the last week of July. By that time our VISA will expire and we will be staying on I-94 validity.

    My question is , will this create any issue? Because after birth of the new born, we need to complete many paper work.

    Based on this scenario, what should be safest time to go for extension for my existing L1-B VISA.I mean should I go now, or should I go in the month of Aug-Sep.

    I will really appreciate valuable suggestions on this scenario.

    People have this misconception that one can extend visa by filing extension. New visa can only be got out side US.

    You need not do anything till Oct-2014. No need to file for your extension. Technically you and your dependents can stay in US till Feb-2017 or till you have completed 5 Years stay in L1B status , whichever is earlier.

    A few weeks before your dependents I-94 Expiry in Oct 2014, file form I539 to request for their extension of status to match your I-94.

    Of course, you need to attend a new visa stamping interview if at all you leave US after July 2014.

      Thx for quick reply.If I apply for extension areound Oct14, will that impact on the documentation of new born..because by that time our VISA will be expired and we will be on I94.

        When you say extension, I hope you mean extension only for your dependents not for you as you anyhow have I-94 till 2017.

        Staying on I-94 is valid and I dont see any issue with that. As for documentation of new born, I don't see any issue as am assuming you would be applying US passport for the new born. What other documentation are you referring to?

        If you are thinking of OCI/PIO for the new born's travel outside US, then you do realize they would need to go for fresh stamping (except the US citizen kid) in order to be allowed re entry. And you would need to too if you leave US.
