  • Period from i94 expiry to L1B denial

    I read in couple of threads that the period after i94 expiration and if you got denial on L1B extension considered to be an illegal stay in USA? If it is the case then in my case my i94 is expiring on 23rd September 2014 and my employer will apply for my L1B extension from USA just before my i94 expiration date. So if my L1B got rejected then my stay from 24th September 2014 to the time I receive denial on my L1B is considered to be illegal stay? And if that's the case then will that impact adversely my future entry to USA or green card processing?

    It should not negatively impact as long as you leave within the time frame allotted in case of extension denial. Keep adequate proof that extension was timely filed before I-94 expiry.

      Do you know usually what that time period is. I heard that USCIS does not specify the date or time period but says something like as early as possible I should leave the county?

        Generally its one week to 10 Days.
