L1 to H1 in the middle of the year

  • L1 to H1 in the middle of the year

    Hi

    Currently I am working in Company A in L1 visa. I am working for the past 1 year, i have validity until 2016. But my current company may close their operations in our site. So i may get layed off. Now if Company B is ready to hire me they can apply for H1B immediately or they have to wait for 2015 April? I am not very sure when they layoff, but if my current company ask me leave, is there any possibility to switch over job in 2014? Or i have to go back to India and apply only in April 2015?

    Please enlighten me how can proceed if i get layed off before 2015 April.

    One more thing i would like to know is if my current employer is generous to change my status from L1 to H1 (it is very unlikely just incase), since H1B COS requested by the same company that process can be done in the middle of the year and it would be faster?

    Do you have a previous H1? If no then in case you get laid off you will have to leave US, apply fresh H1 in April 2015, and if you get selected and approved and stamped then you can travel Oct 2015.
