  • L1 A Denied, When Can I Reapply

    I work for a major MNC in India for about 10+ years. I was in US between 2007 and 2013 on L1 B visa and came back to India in April 2013 to spend 1 year so that I can apply for L1A and get a full quota of 7 years.

    In Oct 2014 I applied for B visa and travelled in Nov 2013 and April 2014 for about 1 month on both the occasions.

    I went for L1A stamping in mid-July (after making sure I was out for 365 days) and was denied.

    I was very confident of getting the L1A visa and am unsure why I was denied.

    My company may file L1A after 6 months in Jan 2015 and if it gets rejected then I will try for H1.

    My question is what are the chances that my L1A will go through or will it be denied again since I was rejected already.

    What needs to be assessed is the reason for your previous L1A rejection and work upon those.

    Can you post the Q&A session you had the officer, it might give some pointers.

      I was asked 4 standard questions:

      1. How many years I have work for ACN
      2. How many resources will I supervise – My response was 8
      3. Who will by my supervisor
      4. Where will be my supervisor located – I told him that he is not based from same region

      He took some notes and then told me that I do not qualify for L1 A Blanket visa and can try for other visa types –L1A Individual or H1/L1B.

        If none of the answers are significantly changing, re applying under L1A would most likely be denied again.

        As advised, go for L1A Individual/L1B Individual/H1B.

                Hi,

                My L1A extension is recently denied and I had to return to India as my I94 was expired. How soon can I reapply for fresh L1A Individual petition? My employer is saying there is cooling period of 365 days? is this rule set by USCIS?
