  • Questions on L1A Approved Extension

    Hi,

    I came to US with my family on L1A Visa last year (Sep 2013) and my Visa was going to expire in (Oct 2014). My company applied for my L1A extension and received the Approved extension for 2 years for me.

    I have the following questions regarding what to do next
    1. Do I need to get separate extension for my family as well since the extension talks only about my extension
    2. Can I stay in US beyond Oct 2014 and then go to India and get a new Visa based on the extension, or do I need to go before Oct 2014 and get a new Visa stamped?
    3. Can my family stay beyond Oct 2014 since they have not received any extension ?
    4. Can I go to Canada and get new Visa stamped with the extension letter for myself and my family

    Appreciate if somebody with knowledge can help me understand what should be best course of action before Oct 2014.

    1. If your family has an I-94 which is also expiring in Oct 2014, then yes, your attorneys should have applied for their L2 extension too. You should do so before their I-94 expires.
    2. If your extension is approved, then it would have come with a new I-94, you can legally stay till that I-94 date. The extended I-94 only allows you extend our current stay, if you leave US after Oct 2014, you would need to go for new visa stamp in order to be allowed entry again. Remember, I-94 allows valid stay, but its a valid visa which allows entry into US.
    3. No. They cannot stay beyond their own I-94 dates, even if you got a new I-94. Every person should have their own valid I-94 in ordered to be allowed stay in US.
    4. Yes it is possible, but Canada was not giving slots for TCNs for L1 visa , do check with US Consulate in Canada.
