  • L2 pregnant , l1 travelling back to india

Hi, I came on L2 visa with my husband one year back. Also I was working with company xyz till June 2014.now I am on short term disability leave due to critical pregnancy. Now my L1 husband wants to go back to india as there is no one to take care of his parents. I cannot travel along with as I am in 6th month of my pregnancy, also my doctor is objecting as I had previous 2 miscarriages.
I also have my own l1 petition approved from xyz company, but it's been 6 month my petition was approved, I could not stamp as I could not travel because of pregnancy.
Please let me know is there any way I can stay in us till my delivery even if my husband travels to india
My L2 visa is valid till 2016

Unfortunately a L2 cannot stay in US for extended period when L1 is not present. Why dont you talk to your employer about moving you from L2 to L1 by filing a COS. Also, isnt your spouse planning to return back for your delivery? You also need to ensure you have proper medical insurance, as without that you would end up with humongous medical bills.

This is my opinion not legal advice.
