  • L1 visa help

    Dear All,

I am an Quality Assurance engineer based in Bangalore, My US visa was refused three times in 7 years.

1st attempt 2006 Jan chennai - B1 visa- I was not carrying the training schedule and the visa was refused
2nd attempt 2006 Oct chennai - B1 visa - I reapplied without any change in circumstance(no change in designation, marital status and age), I was refused under section 214(b)
3rd attempt 2008 Jul chennai- L1 visa - YOUR BLANKET L-1 APPLICATION IS NOT CLEARLY APPROVABLE UNDER SECTION 8 CF 214.2(I)(ii)(D) & INA 101(a)(15)(L), & HAS BEEN REFUSED UNDER SECTION 221(g) OF THE INA

    4th attempt 2013 Feb chennai - B1 visa - Visa was approved
Since I had quite a few of changes in my circumstances when I appeared for 4th time.

    1. Marital status changed
    2. Age above 30
    3. Change in designation as Team leader

Now am applying for L1 visa with same employer with Program manager role, Currently my designation is manager since Feb 2014. Please suggest whether I should apply for L1A or L1B and Blanket or Individual. I have been working with current employer for 9 years and married for 2.5 years (no kids).
Currently my company is processing the application under L1B blanket, I need your help whether I should go head with blanket petition or Individual petition.

    Any suggestion is highly appreciated.

    Thanks In advance,
    Yuvaraj

It is very sad to know that your US visa has been refused for so many times. Anyways, it is better to consult it with some migration expert who can really guide you in the correct direction.

Your current role sounds more suitable for L1A than L1B as L1B is for specialized skill sets. Nonetheless, your employer and their attorney have the documentation in front of them and they would be in the best position to decide.

This is my opinion not legal advice.

        4. Which client you will be working for in US?
I will not be working for client, i will be working at my parent company

        5. Designation in india office?
        Manager

        6. Designation in US office?
        Program manager

        7. What work you will do in US?
        Answered

        8. What is your specialization?
