  • L1B Blanket to L1A Blanket Renewal

    Hello All and Raghvi,

    I have some clarification here with regards to my L1A Blanket Visa that is scheduled on 13th of October. Here is the back ground

    I was on L1B working from Aug 2013 to till date and My L1B Blanket Visa got expired on 20th June 2014 but I have I94 until 2016 Aug. I need to bring my family to USA, for which I asked my legal team to process L1B Blanket extension but my legal office told me that USCIS will reject my extension as I have a valid I94 for the next two years. The Legal team suggested me to do a L1A Blanket Renewal instead, for which I have a petition approval, interview is scheduled and I will be going to India on 13th Oct to attend the Interview. My designation is Program Manager and I have been in the managerial role for the last 3 years. Even before I came to the US in 2013 on L1B, I was in managerial role for more than 2 years in India, but my company only did L1B not L1A. That said, I heard around that if I travel in Oct to India from US and attend the Visa Interview, there are chances of getting a denial because I am on L1B Blanket currently and I will need to work in India for another one year as manager after my return to be eligible to apply for L1A Blanket. Is this True ?

        If you already have L1A petition approval the chances of rejections are less. One can always get promoted while in US and hence move from L1B to L1A without having to work 1 Year outside US as a Manager. In such a scenario the person can go for L1A stamping as and when he/she leaves US.

        This is my opinion not legal advice.

          L1 renewal

          If a person move from L1B blanket to another L1B blanket to the same company when he is in US, should he go out of US, get stamping and re-enter US or he can continue in US without going out of US for stamping?

          I do understand that if he goes out of US for some reason, he has to go for stamping.

          But my question is does he has to go out of US mandatorily in order to continue to work in US. Can some one respond to this query.
