  • Recapture my L1 days -RFE/Denials ?

    Hi,

    My L1B is to expire on 5/11/2015 after 5 years and i just learnt that I can recapture about 177 days which i spent outside US in the last 4 years. But my attorney is saying that the Immigration is issuing many RFE's and denials and there is not a great chance of success.

    Can you please let me know what you think or have seen happening generally?

    It depends upon the strength of your case with respect to skill set and documentation proof you can provide to claim Specialized Skill Set.

    The chances of RFEs have increased manifold in last few years. But if you/your employer dont have a plan of H1/L1A then recapture is the only option to try in order to stay beyond your 5 Year limit.
