  • Re filing extension after denial

    Hi,
I'm currently on L1B which expires on 10/15. My visa max outs in 2 months and my employer had filed an extension for the 2 months. The petition got denied yesterday (reason not yet known) and my employers attorney is saying they will re apply the extension request again before I94 expires. Would like to know if this can be done and is it advisable. Appreciate any advice.

I think an appeal is possible on the existing decision, but not a fresh extension request, yu, your employer and lawyer need to work on the reasons for the denial otherwise the result of an appeal would most likely be the same. I think there is a 33 days limit on appeal too.

This is my opinion not legal advice.
