    Hi,

    I need a suggestion on the below:

    1) Currently I am on L1 VISA and it is valid till 2016.
    2) I applied for H1 through a Sponsor(not my current company) and it got approved on Sep 29th 2014. ( H1 is valid from oct 1st 2014 to oct 2017)


    so do i need to change my status immediately and work on H1 VISA through my new employer? My employer told that he didn't applied for status change yet and i can work on L1 VISA till the time i get new job on H1.


    so if it is correct for how many months i can work on L1 VISA with H1 getting approved.

    You can continue working on L1B visa as long as you have a valid L1B associated I-94 OR 5 Years are not exhausted on L1B (7 Years for L1A), whichever is earlier. Only if COS to H1 was not applied and approved. If COS to H1 was approved then you must work with H1 employer.

    As for H1, are you sure the employer didnt file H1 as Change of Status? If I were you, I would not take their word blindly, but would rather see the documentation myself. Maintaining status is your responsibility not the employer's. Why the H1 employer has not shared any document with you ?

      Hi,

      Thanks for the reply. Employer told me that he didn't applied for status change yet and he shared me the H1 approval I-797 notice.
      he told that he will apply for status change once I get a job (reason being the job market for this quarter will be less).
      How can I verify my status change details ?
