  • L1-Blanket - I94 Extension - Status change from RFE Review to Initial Review

My L1-Blanket Petition and I94 expired in July 2014 and had applied for I94 extension. Received an RFE and a response was filed on 03-Sep-2014. The status on the USCIS website was "Request for Evidence Review" and today (16-Oct-2014) the status changed to "Initial Review" with the below text.

"On October 16, 2014, your address was changed relating to the I129, PETITION FOR A NONIMMIGRANT WORKER that you filed. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance."

Has anyone faced similar situation and if yes, what happened after? Is this an issue and do we need to call up USCIS to get it looked at?

Note: No address changes was done by me, employer and attorney.

Do not read too much into the online status if it does not apply to your case. It seems your request was applied under normal processing timelines, and its already been 3 Months so probably a decision would be made soon.

This is my opinion not legal advice.

      Hi Raghvi,

Thanks for the quick response. Yesterday I received another update to the status as 'Post Decision Activity' and my petition has been approved.

"On October 16, 2014, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."

I am planning to go to India for a vacation in Nov 2014. I would need to get a stamping to come back to the US but I am trying to understand my chances of approval? L1-B Blanket is not eligible for Interview Waiver Program so I have to go for a PA. Will this interview be similar and grueling like my initial interview for the L1-B Blanket Visa or will it be just a formality?

Any additional info will help and is appreciated.

Time taken for documents to reach the company/attorney

My L1-B Blanket I94 extension was approved on 16-Oct-2014, but my company/attorney haven't received the approved petition/I-94 yet. How long does it take for the documents to deliver and what is the mode of delivery that USCIS utilizes?

Will anyone be able to say What is the average delivery time for the approved documents?

16-Oct was nearly a month back, your employer/attorney should typically have received the approval notice. You can ask the employer/attorney to check with USCIS and get a tracking number.
