Hi ,
My brother has applied for l1a visa in mar and after so many rfes , the petition was finally approved . In fact the company had applied in pp, but it still took 6 months to get the approval. Now after he received the approval notice from attorney, we see that he got i797a instead of i797b with i94 attached( approval says above petition and extension of stay approved, type of visa says l1a).
He is in India and not in US. We are so confused and worried. Attorney has asked him to go for visa stamping and asked him to say that it is a fresh petition and not extension . His I-129 clearly says it is new petition and the petition number all matches.
He had valid l1b visa and it got expired in 2010 and he did not travel to US bcos of family circumstances. Infact one of the rfes was why he did not travel in l1b ?
Will it pose a problem during visa stamping ? Has anyone had any experience ? After so much struggle, we are still not out of woods ,bcos of the uscis making mistake ..
I would appreciate if anyone could shed some light ..
