L1 B extension file

Hi,

I am on L1-B visa through my company's blanket petition.

Below are my visa details :

L1 Visa Start Date : JULY 2010
FIRST ENTRY IN US : SEPT 2010
L1 Visa Expiry Date: JULY 2013
L1 I-94 Expiry Date : DEC 2015

Now I am completing 5 years in SEPT 2015 which is a maximum period to stay on L1 B visa but I have got I-94 till DEC 2015.
Should my employer apply an extension before/by SEPT-2015 or on my I-94 expiry which is DEC 2015?

Are you completing full 5 Years of physical stay in US in Sept 2015? If yes then you should not stay beyond that date. If your 5 Years physical stay in US is completing in Dec 2015, you can stay till then.
As for extension filing, L1B cannot be extended beyond 5th Year. You should move to H1 or L1A if you wish to continue stay here beyond 5th Year completion.

I landed in Sep 2010 , after that in total took 1.5 months leave.
Apart from this period i was in US.

To calculate my 5 years i should add this 1.5 Months time to sep 2015 or this period is not applicable as i was employed in US - So sep 2015 is last for me on this Visa ?
