  • L2 to L1A

Hi All, I need clarification on conversion of L2 status to L1A. I have been working for a company in India and now will be joining the same company in the US after I get my EAD card. My company was about to apply for my L1A in India, but my wife's L1B application was expedited, hence had to come here on an L2. My wife's immigration status is L1B and her employer would like to move her to H1B next year. I would like to know if (a) I am eligible for change in status from L2 to L1A (b) process guidance, if any.

If you were eiligible in India within last 3 Years, you most probably would be eligible from US too. the steps would more or less remain same as your company would have followed in India, only major difference being the company would do a L2 to L1 Change of Status application providing your current L2 I-94 info. Once the COS is approved with a new I-94 your status would be L1A.

This is my opinion not legal advice.
