  • Dormant H1 and new L1 filing

    Hi,
I came back from US two years back and i have 1.5 yrs left on my old H1. My current company is filing my L1 B blanket. I have the following qs:
    1. In case i get laid off, can i use the remaining time on h1 by initiating h1 transfer?
    2. Will the time on l1 count towards my total time in US? I have been out of US for 2 yrs already.
    Thx

      1. Yes possible, but you should initiate the L1 to H1 transfer before your last working day. If you are laid off, you will have very limited time to find employer, initiate transfer etc, so plan ahead.
      2. If you decide to use the old H1, yes the previous H1 and L1 time both would get added, if you file a fresh H1 in a new Cap , then only the L1 time will be added.

This is my opinion not legal advice.
