    L2 to dormant H1 with only 10 months left

    Hi Experts,
    My hubby will be travelling with me on L2. We both had H1Bs before. He still has 10 months of unused time on it.
    He wanted to convert to a new H1B. But given the H1 lottery, can his old H1 be used for extensions and as a backup?
    I was thinking that once he applies for gc and gets I 140 approved, can he take up his dormant h1? Will that be eligible for extn?
    Our birth country is India.

    I should probably mention that we have been in india for 2 years now. When we left US, he had 10 months left on H1.

      As long as time is remaining on H1 then what you are planning is theoretically possible.
