Working past I-797 expiry on L1B Individual visa with valid I-94

  • Working past I-797 expiry on L1B Individual visa with valid I-94

    Hi All,

    I am working on L1B Individual visa with following validity:

    1) I-797B -- expiring on May 2015
    2) I-94 -- expiring on May 2016
    3) L1B Visa stamp -- expiring on Nov 2016

    I have following queries:
    1) My company is not willing to file a extension from US and wants me to work on I-94 till May 2016. Is it considered legal to work on I-94 ? They want me to apply for new L1B visa if I return to India before May 2016
    2) What are the chances of rejection for L1B Individual extension since it the original petition was approved by USCIS ?

    Since it was L1 Individual you would need a valid extended petition also in order to work beyond May 2015.
