  • L1B to L1A Extension

    Dear Sir,

Currently I'm in US under L1B Blanket VISA, and my VISA is going to get expired by March'15, I-94 by July'15. Exclusing vacations I'm here for 3.5 years. Please help me with the following questions
    1. What is the latest time I can apply for L1A extension.
    2. Does my I-94 get impacted if my L1A extension gets rejected?
    3. My manager says we can file extension two weeks before I-94 expiry date, is it possible to do that or it will be too late?
    4. Can I apply L1A extension after my VISA gets expired and until I-94 is valid?
    5. How long does it take to get the decisioin of extension?

    Thanks in advance

    Regards,
    Ravi

L1A Visa extension under Blanket Category

I am currently in US and my 3 year term is getting over soon , I have following questions can somebody respond with his/her experience.

    1. Do I need to go for L1A visa interview again at chennai (since L1A blanket is from chennai) or can it be done by sending the passport through drop box - if yes then what is the process.

    2. What happens for my family since they are on L2 - Dependent visa i.e. do they need to go or drop box can be used.

    3. Can you point me to the process so that i can go through online.

    Thanks in advance !!!!!!!

There is no process to do a drop box for Blanket visa holders. You have to appear personally in order to get a new visa stamped in the passport. As for your dependents its illegal and risky too to send passport by courier overseas. Hasnt's your employer filed extension for you?

You have to understand that there is a difference between petition, visa and I-94.

Petition allows you to apply for a visa.
Visa allows you entry into US.
I-94 allows you to stay in US.

Till when is your petition, I-94 valid? Till when is your dependents I-94 valid? Do you plan to travel to India in near future?

This is my opinion not legal advice.

        L1a extension and l2 extension

        Hi Raghvi

Thanks for your reply . The question was meant for me and posted by my friend . Here is the situation
I travelled to US in 2011 on l1a blanket petitiin and my wife n kid got L2 . My visa had expired in June 2014 and now I am traveling to india . So I need to get my visa stamped again. The question I have is
        1) do I need to go to chennai since it was blanket though originally I got it in dehi in 2011
        2) if yes , do my family also need to travel with me or they can use drop box facility in delhi
        3) if my family can use drop box , then does it mean they have to do it once I get the visa or it can be simultaneously done or even before
Also please note that I have approved blanket petition and valid i94 with me which is valid till June 2016
Any help in answering the above question would be great

          1. Yes, rule shave changed since 2011.
2 & 3. Technically they can avail drop box facility but only after you have got your visa already stamped. Factor in the time iit would take for you to go for stamping and get the passport back. Also remember that even if one is eligible for a dropbox the consulate reserves the right to call for interview or not.

Your and dependents current I-94 pretty much loses its significance the moment you leave US shores.

You would need to process fresh DS-160 for yourself and dependents ,and I129s for yourself and go through the interview process like you did earlier.

This is my opinion not legal advice.

Will I qualify for the Interview Waiver Program "Dropbox"? if i ask for my lawyer , she said i can apply as both are in the same classification ( L)

But my doubt is VIsa type is differnt ( :L1B and L1A). Could you please let me know am i qualify for interview waiver program or not ?
