  • L1B to L1A extension - Urgent

    Dear Sir,

    Currently I'm in US under L1B Blanket VISA, and my VISA is going to get expired by March'15, I-94 by July'15. Exclusing vacations I'm here for 3.5 years. Please help me with the following questions
    1. What is the latest time I can apply for L1A extension.
    2. Does my I-94 get impacted if my L1A extension gets rejected?
    3. My manager says we can file extension two weeks before I-94 expiry date, is it possible to do that or it will be too late?
    4. Can I apply L1A extension after my VISA gets expired and until I-94 is valid?
    5. How long does it take to get the decisioin of extension?

    You are on L1B then why doing an L1A extension? Is your employer doing a L1b to L1A conversion for you?

    1. Before I-94 expiry.
    2. Not necessarily.
    3. It is possible.
    4. Until I-94 expiry.
    5. 2-6 Months in normal processing, 2-6 weeks in premium. If no RFE.

      Thanks for the response. My employer is doing L1B to L1A conversation as my stay in US is nearing 4.5 years on L1B. In this case will it be treated as new petition?

        Yes it would be a new petition. Did you get promoted recently or the promotion happened earlier?

          Yes sir, I will get promoted next year.

          So if this is considered a new petition then will I be able stay here after my I94 expiry, with my conversion filed?
