    Hello

    I have entered the US with L1B visa in June 2010 & my current I-94 validity is till Jul 2015. My visa has expired in 2013 and I have requested my employer to file change of status to L1A.

    As per the info provided the Change of Status to L1A requires the candidate to have 1 year of managerial experience outside of the US prior to the entry date (in my case prior to 2010). I don't have that experience and hence the employer has mentioned that they cannot file change of status. Please advise on the options that might be possible.

    L1B to L1A can also be filed if one gets promoted while in US, provided the employer has the right legal counsel and will to do so.

      Thanks Raghvi - so in simple terms for L1B to L1A change of status (based on promotion) there is no requirement that the candidate should have had prior managerial experience at all. Given that his new role after promotion is managerial the application can be file for change of status.
