  • L1A RFE - After Response changed to Premium- What are Pro's and Con's

    Dear All,

Currently , I am on L1-B with Visa Validity till Feb,14,2015.
My Employer has applied for Status change to L1-A in Aug,2014. Received an RFE in Sep,2014. RFE response was sent on Nov,2014.
Status in USCIS is "A response will be sent before Jan,18,2015".

As I have very less time, today we applied the same in Premium Process.

    Please let me know,
    1. Will there be any impact on my case , because of changing to Premium.
    2. How quick we can expect response.

Also, my wife EAD(L2) is in process of renewal , which we applied on Nov, 03,2014.
    Please let me know,
    1. RFE on my case , will impact EAD?
2.Will she receive RFE? because of my case?
3.Here renewal will be dependent on my I-94? or my visa status?

    I am very much worried.

    Please help me.

    Thanks
    Sampath

    1. Just moving to premium alone should not in itself have a negative impact.
    2. 15 Days.
    1. Well, it most probably will as your extension beyond 15th Feb is still pending. Is your I-94 also expiring 15th Feb 2015?
    2. Maybe.
    3. Depend upon your I-94.

This is my opinion not legal advice.

      Thanks Raghvi.

Today I received my I-129 approval.
So, my wife's EAD renewal process(started on Nov 03,2014) will also be approved now?

By the way, I have my I-94 validity till Feb 15th ,2015 only.

Please let me know your comments.

      Thanks

Didnt you get a new I-94 along with the I129? Check the bottom half of the the I797 approval notice.

This is my opinion not legal advice.

          Thanks again Raghvi.

I did not receive approval notice.
What I mean is, in USCIS site my receipt number status is "Approved".

I would like to let you know that, while fileing(renewal) my wife EAD, my immigration team mentioned my I-129 receipt number.
So, as my I-129 is approved, my wife EAD also will be approved?

Please let me know your comments.

          Thanks
