  • Grace Period in US after Resignation

    Hello,

I came to US on L1B visa and I resigned from my company to go back to India. My last day with my company is 15th Jan. Just want to know if I fly on 18th or 19th Jan, can it be a problem? Typically how many days grace period is allowed when someone goes out of status?

    Thanks in Advance

Technically zero days. But a few days extra is generally acceptable.

Nonetheless, if you want to absolutely avoid mentioning overstay period in subsequent visa application(s), then advisable to leave on your last work day/pay day.

This is my opinion not legal advice.

I was in a similar situation. the earlier opinion seems to be correct.
I planned to move-out 3 days ahead of last working day in order to ensure that visa remains valid during transit. I planned such that last working day is in home country.
the status in home country will be non-resident so having 1 day wage in home country should not be a major issue.
I took leave for these 3 days.
Having a valid visa during travel can help.

(this is not a legal opinion)

      Regards
      Durga.
