  • L1A clock reset

    Hi All,

I was in L1b from Aug 2008 till Feb 2012.My L1B got converted to L1A(Individual ) in 2012 and then I went back to India in June 2013. I came back on the same L1A petition in Oct 14.Now I want to ask is my L1A reset for 7 years and can I continue on the same petition for 7 years.I checked with couple of lawyers and they answered positively for this but wanted to check if anyone else has experienced the same

I dont think so. As you used the L1A petition in continuance of L1B, and after staying out for more than a year you did not file a new petition, rather you plan to use the old petition again so previous L1B and L1A stay would get added. The rule is to use a Fresh petition AFTER completion of 1 Years stay outside US, in order to get a clock reset.

This is my opinion not legal advice.
