I have worked in US for 7 years from 2007 to 2014 on H1-B. I have been very unfortunate with 221g each time I applied for H visa. Even my labor went into audit and was denied. So I had to leave the country immediately in Jan 2014. When I was pushed out of the country I went back to India and continued working remotely from there. From India my employer initiated work permit for Canada which came in few months and then I moved to Canada in July 2014. Since then I was counting days. I left US in Jan 2014. My one year outside US will finish after two weeks. I asked my company's attorney to file for L1A. He said they already have a blanket petition approved for all L visas. I should just take a print out of that along with some more docs which they'll send and take appointment from consulate. The attorney doesn't know that even though I was out of US for one year but I joined in Canada only six months ago. I was reading on google that the req to get L visa is that you should be employed for a foreign employer for at least one year. Is that correct? Should I wait till July to take appointment? Please advice.
Second question is L1A vs L1B. My title is equivalent to manager but I have no reports. I was wondering if I can still apply for L1A. Please suggest.
