    Both me and my spouse came to US on L-1B and we have been here in US for last 3 years.

    My spouse went back to India for a vacation and when coming back to US she could get her I-94 extended. Her visa expires April 2015 and now has the I-94 until 2017.

    Both my visa and I-94 expires in April 2015.

    I'm thinking of resigning from my company and to go on L2 depended visa under my spouse.

    My question is, can I apply for dependent when my spouse is only on I-94 (not on visa)? If yes then what is the procedure? Do I need to go back to India to get the L2 visa or can I get it done without leaving US?

    You will not be able to apply for a dependent visa if the primary visa has expired.
