  • L2 Visa Based on I-94

    Hi,

    I have valid I-94 till 9/15/2016 and my visa, I-129S expired on 2/01/2015. My wife's visa and I-94 expired on 2/01/2015.

    We have submitted the application i-539 to extend I-94 for her with all the documents mentioned in the website in Nov 2014.

    We have sent the Docs: I-94(mine and spouse), passport copies, marriage certificate.

    Last week we recieved RFE , mentioning below.

    "Your Form I-539 indicates that your nonimmigrant status, as the (L2) dependents of an (L1) principal nonimmigrant, Your submission did not include evidence that the principal beneficiary was extended in a valid (L1) status at the time of filing this application. Please provide the following documentation as evidence in support of your application.

    Form I-797A, Notice of Action: Submit a photocopy of the Form I-797, Notices of Action(Approval Notices), granting your spouse any change(s) of status of extension(s) of stay in the United States.
    Maintaining Status: Submit at least three pay stubs that are dated prior to the filing of the I-539 to establish that the principal has maintained his/her status."


    We have Form I-797 Blanket petition which is valid indefinetely, Kindly advise whether we can submit this I-797 document alone along with pay stubs as response to RFE or should we need to include any other docs like expired I-129S etc.,

    Your response would be very helpful to us.

    You need to include your I-129S as well as your I-94, idea is to provide all relevant documentation at one go to soeed up the extension process.
